Free Stagecoach Tickets Contest at Bootbarn.com!
The 2007 Stagecoach Music Festival is only a month away. Artists will perform in four distinct performance areas including the main stage, an alt-country stage, a bluegrass stage and a storytelling area making for two jam-packed days of music. Terms of Use
Terms of Use and Legal Notice
Welcome to the BootBarn.com website of AM-PAT, Inc (dba Boot Barn). BootBarn.com provides its services and website to you subject to the notices, terms, and conditions set forth in this agreement. In addition, when you use any BootBarn.com service (e.g., Customer Reviews, Blog Postings), you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they are incorporated into this Agreement by this reference. BootBarn.com reserves the right to change this Site and these terms and conditions at any time. Accessing, browsing or otherwise using this website indicates your agreement to all of the terms and conditions within this agreement. Please read this agreement carefully before proceeding.
General Agreement
(A) This Agreement, which incorporates by reference other provisions applicable to use of the BOOT BARN Website, including, but not limited to, governing the use of certain specific material contained in BOOT BARN Website, sets forth the terms and conditions that apply to use of BOOT BARN. By using BOOT BARN Website (other than to read this Agreement for the first time), you agree to comply with all of the terms and conditions hereof. The right to use BOOT BARN Website is personal to you and is not transferable to any other person or entity. You are responsible for all use of Your Account (under any screen name or password) and for ensuring that all use of Subscriber's Account complies fully with the provisions of this Agreement. Subscriber shall be responsible for protecting the confidentiality of Subscriber's password(s), if any.
(B) BOOT BARN shall have the right at any time to change or discontinue any aspect or feature of BOOT BARN Website, including, but not limited to, content, hours of availability, and equipment needed for access or use.
USE OF SITE
Subject to the terms and conditions of this Agreement, BootBarn.com hereby grants you a limited, revocable, non-transferable and non-exclusive license to access and use the Site by displaying it on your internet browser only for the purpose of shopping for personal items sold on the Site and not for any commercial use or use on behalf of any third party, except as explicitly permitted by BootBarn.com in advance. Any breach of this Agreement shall result in the immediate revocation and termination of the license granted in this paragraph without notice to you.
Except as permitted in the paragraph above, you may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit this Site or any portion of it unless expressly permitted by BootBarn.com (AM-PAT, inc) in writing. You may not make any commercial use of any of the information provided on the Site or make any use of the Site for the benefit of another business unless explicitly permitted by BootBarn.com in advance of such use. BootBarn.com reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if BootBarn.com believes that customer or website use or conduct violates applicable law or is harmful to any of BootBarn.com's interests.
You shall not upload to, distribute, or otherwise publish through this Site any Content, information, or other material that (a) violates or infringes the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person; (b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under U.S. or international law; or (c) includes any bugs, viruses, worms, trap doors, Trojan horses or other harmful code or properties.
BootBarn.com may assign you a password and account identification to enable you to access and use certain portions of this Site. Each time you use a password or identification, you will be deemed to be authorized to access and use the Site in a manner consistent with the terms and conditions of this Agreement, and BootBarn.com has no obligation to investigate the authorization or source of any such access or use of the Site. This includes and without limitation all communications, transmissions and all financial obligations incurred with such access. You shall immediately notify BootBarn.com of any unauthorized use of your password or identification or any other breach or threatened breach of this Site's security.
REVIEWS AND COMMENTS
Except as otherwise provided elsewhere in this Agreement or on the Site, anything that you submit or post to the Site and/or provide BootBarn.com, including without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions and will be treated as non-confidential and non-proprietary, and BootBarn.com shall have the royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from such submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or decompile such submissions. All submissions shall automatically become the sole and exclusive property of BootBarn.com and shall not be returned to you.
In addition to the rights applicable to any submission, when you post comments or reviews to the Site, you also grant BootBarn.com the right to use the name that you submit with any review, comment, or other Content, if any, in connection with such review, comment, or other content. You represent and warrant that you own or otherwise control all of the rights to the reviews, comments and other content that you post on this Site and that use of your reviews, comments, or other content by BootBarn.com will not infringe upon or violate the rights of any third party. You may not use BootBarn.com's trademarks or service marks in any manner that disparages or discredits BootBarn.com. You shall use BOOT BARN Website for lawful purposes only. Subscriber shall not post or transmit through BOOT BARN Website any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without BOOT BARN's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a Subscriber that in BOOT BARN's discretion restricts or inhibits any other Subscriber from using or enjoying BOOT BARN Website will not be permitted. Subscriber shall not use BOOT BARN Website to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with BOOT BARN Website.

TERMINATION AND EFFECT OF TERMINATION
In addition to any other legal or equitable remedies, BootBarn.com may, without prior notice to you, immediately terminate the Agreement or revoke any or all of your rights granted under this Agreement. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and BootBarn.com shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this Agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.
DISCLAIMER AND LIMITATION OF LIABILITY
This Website, The products offered for sale on it and the transactions conducted through the website are provided by BootBarn.com (AM-PAT, Inc.) on an “As Is” basis. BootBarn.com (AM-PAT, Inc) makes no representations or warranties of any kind (express or implied) on this website. To the fullest extent permissible by applicable law, BootBarn.com (AM-PAT, Inc) disclaims all warranties, data accuracy and overall system integrity. Though it is not our intention, this site may included inaccuracies, mistakes or typographical errors. We, BootBarn.com, do not warrant that the content will be uninterrupted or that it will be error free.

TYPOGRAPHICAL ERRORS

CHANGED TERMS
BOOT BARN shall have the right at any time to change or modify the terms and conditions applicable to your use of BOOT BARN Website, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately without notice
